Duluth Fence & Deck provides residential deck building, fence installation, pergola construction, screened porch installation, and related outdoor structure services in the Duluth, MN area and surrounding communities. All services are provided by appointment. We do not accept walk-in customers at our office location.
Website content describing our services is provided for general information only. Availability, scope, and pricing are subject to change and must be confirmed in a written estimate before work begins.
All estimates provided by Duluth Fence & Deck are free and non-binding until a written contract is signed by both parties. Estimates are based on the scope of work, materials, and site conditions at the time of the on-site visit. If conditions change or the scope of work changes after an estimate is issued, pricing may be adjusted and a revised estimate will be provided before additional work proceeds.
Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. We are not responsible for price increases in materials that occur after an estimate expires.
Project start dates are confirmed in writing at the time of contract signing. Start dates are subject to change due to weather, permit delays, or other factors beyond our control. We will notify you as early as possible of any schedule changes.
If you need to cancel or postpone a scheduled project, please contact us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials purchased and labor performed. Specific cancellation terms will be outlined in your written contract.
Payment terms are set forth in the written contract for each project. In general, we require a deposit at the time of contract signing to secure your place on our schedule and cover initial material costs. The remaining balance is due upon completion of the project and your final walkthrough. Specific payment milestones for larger projects will be outlined in the contract.
Invoices not paid within the timeframe specified in the contract may accrue late fees at the rate permitted under Minnesota law. We reserve the right to suspend work on a project if payment obligations are not met.
Duluth Fence & Deck obtains all required building permits for projects that require them under applicable local and state regulations. Permit fees are typically included in your project estimate or itemized separately. We will not knowingly perform work that requires a permit without obtaining one. You agree to provide us with reasonable access to your property for permit-related inspections.
Duluth Fence & Deck warrants our labor and workmanship for a period specified in your written contract. This warranty covers defects in installation and construction resulting from our work. It does not cover damage caused by normal wear and tear, weather events, misuse, lack of maintenance, or conditions outside our control.
Materials and products installed by Duluth Fence & Deck may carry separate manufacturer warranties. We will provide you with any available manufacturer documentation. We are not responsible for manufacturer warranty claims beyond facilitating your access to that documentation.
The website at duluthfenceanddeck.com is provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be error-free or continuously available.
To the fullest extent permitted by law, Duluth Fence & Deck shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including weather, material shortages, permit delays, labor disputes, or acts of government.
You agree to provide accurate information when requesting an estimate or submitting a contact form. You are responsible for informing us of any known underground utilities, property lines, HOA restrictions, or other site conditions relevant to your project before work begins. We are not liable for damage caused by conditions you failed to disclose.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any legal action arising under these terms shall be filed in the courts located in Minnesota.
